A 58-year-old man arrested after the deadly Emmarentia road rage shooting has been released after his expected first appearance in the Johannesburg Magistrates’ Court did not go ahead on Tuesday, 21 April 2026. According to The Citizen, the matter was not enrolled on the court roll after an application by the man’s legal team.

The case stems from a suspected road rage incident in Emmarentia in which a motorist was allegedly shot and killed while his wife was also wounded. The incident is believed to have followed a minor bumper-bashing.

The man’s lawyer, Advocate Muhammad Yusuf Razak, told The Citizen that the defence submitted what he described as a comprehensive warning statement setting out the suspect’s version of events. Based on that statement, the state chose not to prosecute at this stage. Razak said the matter could now likely proceed to an inquest, although he added that the state could still change course if further investigation leads to a different finding.

That means the release is not necessarily the end of the case. It simply marks a pause while investigators continue to examine what happened during the confrontation.

Self-Defence Claim at Centre of Case

According to the warning statement quoted by The Citizen, the suspect claims the confrontation was started by the deceased and later escalated into a crash and a physical altercation. He alleged that the couple verbally abused and physically assaulted him before the woman produced a firearm, fired a shot and handed the weapon to the deceased, who also allegedly fired at him.

He then claims he returned fire. In his version, the deceased fell and dropped the firearm, after which the woman allegedly picked it up and pointed it at him. He said he fired again, striking her in the lower arm, and believed the threat to his life had been neutralised. He maintains that he acted in private defence throughout.

Police Still Investigating

Gauteng police previously said both drivers allegedly drew firearms after a female passenger, believed to be one driver’s wife, went to fetch a gun from a vehicle. Police said the shooting left one man dead and both the other driver and the woman injured. Officers are investigating murder and attempted murder.

The case has also reignited concern around road rage in South Africa, with police urging motorists to stay patient, follow the rules of the road and avoid confrontations that can turn deadly in seconds.
