The Labour Appeal Court delivers its verdict today in the Phahlane dismissal case. Former acting National Police Commissioner Lt Gen Khomotso Phahlane will finally learn whether his 2020 dismissal stands or if he returns to the SAPS.
Phahlane was fired for alleged unlawful conduct in a 2014 forensic cameras tender worth R92.8 million. He has fought the decision through the High Court and Labour Court, both of which ruled against him.
Case Rooted in Suspension and Tender Dispute
Phahlane told Parliament’s Ad Hoc Committee on 14 January 2026 that his 2017 suspension by then Minister Fikile Mbalula was unlawful. He also denied responsibility for a R24 million payment made while he was already suspended.
He described himself as the first high-profile victim of the ANC’s step-aside policy and repeated claims that Robert McBride and Paul O’Sullivan conspired against him.
The Ad Hoc Committee, probing allegations by Lt Gen Nhlanhla Mkhwanazi, continues until 20 February 2026. Phahlane was the first witness in the current round of oral evidence.
Next Steps After Today’s Judgment
No response has been received from Phahlane or his legal team ahead of the ruling. The committee’s evidence leader, Advocate Norman Arendse SC, has yet to complete cross-examination.
